Indeed, it seems to have started as soon as The Post’s Bernadette Hogan first revealed the existence of the deadly March 25 order by asking about it at a press conference weeks later. At that April 20 presser, the gov pretended he’d never heard of the order before. (And never mind that he is tight as a bug with the state hospital lobby, which plainly requested the order if only to clear beds for more urgent COVID cases. Nor that Cuomo is a notorious micromanager unlikely to let such a deadly mandate be issued without his personal signoff.)

It’s at about this point that the state Department of Health suddenly started reporting “nursing home COVID deaths” in a way unique to New York — leaving out residents who died only after transfer to a hospital. This, even as the DOH continued to record the full truth but refused to share it.

Indeed, the Cuomoites stonewalled Freedom of Information Law requests from the Empire Center and the Associated Press for most of the next year — again, starting long before the feds showed any interest.

The state only finally started releasing that info after 1) Attorney General Tish James’ report outlined the basic fact that the nursing-home death toll was 50 percent higher than Cuomo or Health Commissioner Howard Zucker had been admitting, and 2) a judge outright ordered the DOH to comply with the Empire Center FOIL request.

Democrats slam ‘lying’ Andrew Cuomo over COVID-19 nursing home scandal

Fellow Democratic legislators in New York weren’t buying Gov. Andrew Cuomo’s explanation Monday as to why he refused for months to release a true accounting of nursing home residents who died from the coronavirus.

Assemblyman Ron Kim (D-Queens), whose uncle died from COVID-19, bluntly said that “all of it is BS” and a cover-up.

“They could have given us the information back in May and June of last year. They chose not to,” Kim said after hearing Cuomo was blaming the Department of Justice probe for delays in releasing the accurate coronavirus death tally of nursing home residents.

Cuomo ducked press demands for nursing-home mortality data throughout 2020, even as every other state made the information public. While New York admitted to about 7,000 nursing home deaths, informed estimates put the real count at around 12,000; the state refused to confirm the numbers. Last month, Attorney General Letitia James released a report acknowledging that the real death toll was close to 13,000. In reaction to this news, Cuomo snapped, “Who cares? 33 [percent], 28 [percent]. Died in a hospital. Died in a nursing home. They died.”

What this episode reveals is Andrew Cuomo’s massive egotism. He was elevated by a fawning national media into a preposterously salvific role last spring and summer. Throughout the course of the pandemic, the governor gave daily televised briefings in which he hailed his own performance as a beacon of leadership. Cuomo delivered such apothegms as, “It’s going to be hard, there is no doubt. But at the same time it is going to be OK.” He also made a point, continuously, of calling the novel coronavirus the “European virus,” presumably in counterpoint to Trump’s calling it the “China virus,” though it is widely recognized that the virus originated in China, even if some infected people may have caught it in Italy before bringing it to America.

Public Officials See Salaries Inflate With COVID Overtime

Among all county employees, 1,226 staffers received $5.9 million in overtime related to the new coronavirus health crisis last year and saw their paychecks grow thanks to federal CARES Act stimulus money awarded to Erie County. But of the nearly $6 million in Covid-19-related overtime paid out last year in federal funds, 54 political appointees received $1.3 million of it. In other words, those 4.4 percent of the workers got 22.1 percent of the money.

These government administrators would not typically receive overtime pay. However, Erie County Executive Mark C. Poloncarz allowed all non-union, managerial confidential employees to accept overtime pay for their Covid-19 related work because he said his administration received explicit guidance that CARES Act federal stimulus money allows non-union managers to collect it.

The Democratic governor’s budget plan has a basic premise: Red ink will be washed away only if his request for a bailout from the federal government happens.

Cuomo’s new budget assumes the federal government will give New York at least $6 billion over two years as part of a broader $1.9 trillion Covid-related stimulus package being negotiated by Democratic President Joseph Biden and the Democratic-led Congress.

DiNapoli: Chatham Police Chief Pleads Guilty to Pension Double-Dipping and Defrauding Village

DiNapoli, Columbia County District Attorney Paul Czajka, and the New York State Police today announced the guilty plea of former Village of Chatham Chief of Police Peter Volkmann following a joint investigation. As a result of his conviction, Volkmann is required to leave public office.

Volkmann pleaded guilty to grand larceny in the fourth degree for circumventing New York state’s post-retirement income restrictions and cheating the New York State and Local Retirement System out of $74,222. Volkmann hid public-source income from 19 municipalities and school districts in excess of the statutory limit by funneling the earnings through a private business, PF Volkmann & Associates. He also plead to official misconduct, a misdemeanor, for stealing $18,607 from the Village of Chatham by falsifying mileage vouchers and other reimbursements to increase his income. Volkmann will pay a total amount of restitution prior to sentencing in the amount of $92,829 as part of his plea and as a result of his conviction has been removed from office.

DiNapoli: Westchester Sisters Sentenced for Stealing Deceased Mother’s Pension

State Comptroller Thomas P. DiNapoli and Westchester County District Attorney Miriam E. Rocah announced the sentencings of Annette Bigelow, 61, and Mary Nash, 59, who hid their mother’s death to pocket nearly $22,000 from the New York State and Local Employees Retirement System, which DiNapoli administers, from 2013 to 2015.

The two daughters pleaded guilty to felony grand larceny last September. They were sentenced to a three-year conditional discharge and ordered to pay full restitution of $22,000.

Many law enforcement agencies are continuing to see a high rate of identification-theft cases involving individuals whose personal information was illegally used to apply for unemployment benefits during the ongoing coronavirus pandemic.

Some of the recent cases are coming to light when individuals are receiving bank debit cards or paperwork in the mail indicating they were approved for federal pandemic unemployment assistance that they never applied for.

In other instances described by law enforcement officials, victims are learning they have been defrauded when they receive tax forms instructing them that the unemployment benefits they received last year are reportable income — although those individuals were not aware that someone had applied for or received the benefits using their identity. In some cases, multiple individuals from the same organizations — school districts, professional firms or government agencies — were victimized. That, according to law enforcement experts, could be tied to data breaches involving those entities.

Lawmakers Propose Early Retirement Incentives for Public Workers

Public workers in New York could have an incentive to retire early under a proposal by a pair of state lawmakers unveiled on Thursday. 

The bill backed by Sen. Peter Harckham and Assemblyman Tom Abinanti would create early retirement incentives for workers 55 and older who have 10 years of service with state or workers with 25 years of government service. A separate bill that covers early retirement for public workers in New York City was previously introduced. 

The bill comes as local government finances have been scrambled by the COVID-19 pandemic. Revenue from the sales tax, for instance, dropped 10% statewide.

New York State Senate Republicans, and now, a growing number of Democratic Senators, are seeking a special session in an effort to remove Gov. Andrew Cuomo’s emergency powers in the wake of the report into the underreporting of COVID-19 deaths in nursing homes statewide.

Senate Republican Leader Robert Ortt and members of the Republican Conference called on the Senate Majority to convene a special session and strip Cuomo of his emergency powers while calling for a thorough investigation into his administration. They were later joined by 14 Democratic senators.

More than 9,000 recovering coronavirus patients in New York state were released from hospitals into nursing homes early in the pandemic under a controversial directive that was scrapped amid criticism it accelerated outbreaks, according to new records obtained by The Associated Press.

The new number of 9,056 recovering patients sent to hundreds of nursing homes is more than 40% higher than what the state health department previously released. And it raises new questions as to whether a March 25 directive from Gov. Andrew Cuomo’s administration helped spread sickness and death among residents, a charge the state disputes.
